New Mexico Minimum Car Insurance Requirements

Coverage	Requirements
Bodily Injury Liability	Bodily Injury Liability covers expenses related to bodily injury or death when you are found at fault in an accident. The minimum insurance is $25,000 for one person and $50,000 for injury or death of more than one person.
Property Damage Liability	Property Damage Liability covers damage expenses in an accident in which you are at fault. The minimum insurance is $10,000 per accident.
Comprehensive Coverage (Optional)	Helps cover vehicle repair after damages caused by non-accident events such as vandalism, theft, fire, flood and more.

New Mexico Car Insurance Laws And Regulations

New Mexico Driver’s License Process

Driver’s Permit

To apply for a driver’s permit in New Mexico, you must be at least 15 years old and:

• Submit proof of identity, federal identification number and New Mexico residency
• Submit evidence of enrollment at a driving school
• Complete a written test
• Bring your parent or guardian to sign for you (an adult who is 21+ and has had a license or ID for 3+ years)

Provisional License

If you are between 15½ and 17 years old, you can apply for a provisional license. Along with proof of identity and residence, you must have:

• Held a permit for at least six months
• A driving school completion certificate
• A 50-hour driving log, with a minimum 10 hours of night driving
• Passed a driving test
• A parent or guardian to sign for you (an adult who is 21+ and has had a license or ID for 3+ years)

First Time License

If you are 18 or over, you may apply for your first-time driver’s license. You must show proof of identity and residence, along with:

• A passing score on a written test and a driving test
• A None For The Road completion certificate

Driver’s License

To apply for a driver’s license, you must:

• Be 18 or have held a provisional license for one year
• Not have any traffic violations for 90 days before you apply
• Not have any alcohol or drug-related offenses
• Have a parent or guardian sign if you are underage

If you are a new resident, you must show proof of identity and New Mexico residency to apply for a New Mexico driver’s license.

Driving Without Insurance In New Mexico

It is illegal to drive without auto insurance in New Mexico. You must have proof of insurance in your vehicle at all times.

If you are caught driving an uninsured vehicle, your license and registration will be immediately suspended. You may be fined up to $300 and face 90 days in jail, even if it is your first offense. For a second offense, you will face six months of jail time and a fine of up to $1,000. Additional offenses can lead to stricter sentencing.

If you receive a Notice of Suspension of Registration Letter, you must return your license plate and registration within ten days, or face penalties.

New Mexico Teen Driving Laws

If you have an instruction permit, you are only permitted to drive if you are accompanied by an adult who is 21+ and has had a driver’s license for a minimum of three years.

If you have a provisional license, you are not permitted to transport more than one passenger under the age of 21 unless they are family members.

You are not permitted to drive between midnight and 5 a.m. with a provisional license. This curfew does not apply if you:

• Are driving with a licensed driver who is at least 21 years old
• Are driving to/from school/work/religious activities
• Are driving due to medical/family necessity

New Mexico Seat Belt Laws

New Mexico requires all passengers to wear seat belts. As a primary enforcement state, you can be pulled over and fined if you are not wearing a seat belt.

When transporting children between 7 and 12 years old, you must use a safety or booster seat.

New Mexico Distracted Driving

New Mexico has distracted driving laws in place to help drivers keep their attention on the road and prevent accidents.

You can use your cell phone only with a hands-free device. You are allowed to use GPS features, but texting or talking on your cell phone is against the law.

Penalties for texting while driving start at $25 for the first violation and $50 for subsequent violations.
